looks ANGELES -- Mel Gibson was charged Wednesday with misdemeanor given to intoxication [i]or[/i] drink driving, having an elevated blood-alcohol of the same height and having an open container of tequila in his car.

The three cast ups were filed by Los Angeles shire prosecutors five days after Gibson was twitched over on Malibu's Pacific Coast Hwy for speeding. He later apologized for making anti-Semitic annotations to the arresting deputy.

The charges did not mention Gibson's self-described "belligerent behavior" toward the legate or any allegation of speeding. Arraignment was place for Sept. 28 in Malibu Superior Court.

If convicted, Gibson faces up to six month in jail, the district attorney's office said.
